1. About Coulter

Coulter ("we", "us", "our") is a homesteading and self-sufficiency management platform that provides tools for garden planning, livestock tracking, harvest logging, food storage, AI-powered advice, and related features. These Terms govern your use of the Coulter website, application, and all related services (collectively, the "Service").

2. Eligibility

You must be at least 18 years of age to use the Service. By using Coulter, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are using Coulter on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

3. Account Responsibilities

When you create an account with Coulter, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your login credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately if you suspect unauthorised access to your account

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in harmful conduct.

4. Subscription Plans and Billing

Coulter offers paid subscription plans providing access to premium features. By subscribing, you agree to the following:

• Subscription fees are charged at the beginning of each billing cycle
• All fees are stated in the applicable currency and are inclusive or exclusive of taxes as required by law
• Payments are processed securely through Stripe. We do not store your credit card or payment details directly
• Your subscription will automatically renew monthly at the end of each billing period unless you cancel before the renewal date
• We reserve the right to change subscription pricing with reasonable advance notice to you

5. Cancellation

You may cancel your subscription at any time through your account settings (Stripe billing portal) or by contacting us at coulter-homestead@proton.me. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until your current subscription period ends. We will not charge you for the next billing cycle once you have cancelled.

6. Refund Policy

Subscription fees are generally non-refundable for the current billing period once commenced, except where required by applicable consumer protection law. If you believe you have been charged in error, contact us within 14 days of the charge at coulter-homestead@proton.me and we will review your case promptly. We may offer refunds at our discretion in exceptional circumstances. Nothing in this policy removes any rights you may have under applicable consumer law in your jurisdiction.

7. Free Trials and Promotions

We may offer free trials or promotional pricing from time to time. Unless otherwise stated, at the end of a free trial your account will automatically convert to a paid subscription. You can cancel during the trial period to avoid being charged. Promotional offers are subject to their stated terms and may be withdrawn at any time.

8. Acceptable Use

By using Coulter, you agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorised access to any part of the Service or its systems
• Interfere with or disrupt the integrity, performance, or security of the Service
• Use automated scripts, bots, or scrapers to access the Service without prior written permission
• Upload content that is offensive, defamatory, harassing, or violates the rights of others
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service to distribute spam, malware, or any other malicious content

9. User Content

You retain ownership of content you submit to the Service (including diary entries, photos, records, and other data). By submitting content, you grant Coulter a non-exclusive, royalty-free, worldwide licence to store, process, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for all content you upload or submit. You warrant that your content does not infringe any third-party rights and complies with applicable laws.

10. Photo and Image Uploads

When you upload photos or images to the Service (including for Plant Doctor AI analysis), you grant us permission to process those images using AI tools to provide requested features. Images may be analysed by third-party AI providers subject to their privacy practices. Do not upload images that include sensitive personal information beyond what is necessary for the feature.

11. AI Features and Limitations

Coulter uses artificial intelligence to generate recipe inspiration, homesteading suggestions, and analysis. You acknowledge and accept that:

• AI-generated content is recipe and homesteading inspiration only and does not constitute professional food-safety, allergy, medical, nutritionist, dietetic, canning, preserving, or any other professional advice
• AI responses may be inaccurate, incomplete, or unsuitable for your specific situation
• AI responses may not be reviewed by a human before being shown to you
• AI does not and cannot guarantee that any recipe is allergy-safe, pregnancy-safe, medically suitable, shelf-stable, or safe for long-term storage
• You must independently verify all AI-generated recipes, including ingredients, allergens, cooking temperatures, storage times, and suitability for your household, before preparing or consuming any food
• We are not liable for any losses arising from reliance on AI-generated content

11A. Canning, Preserving, and Food Preservation

⚠ Critical Safety Notice

This service does not provide canning, preserving, bottling, pressure canning, water-bath canning, shelf-stable storage, or long-term food storage instructions. Improper canning and food preservation can cause serious illness, including botulism, which can be fatal. Any recipe provided by this service is intended for fresh use or freezer use only unless otherwise explicitly stated. For any canning or preservation activity, you must follow tested recipes from an official food-safety authority and your equipment manufacturer's instructions.

11B. Allergy, Medical, and Dietary Advice

This service does not provide allergy-safe guarantees, medical advice, dietetic advice, nutritional therapy, pregnancy dietary advice, infant-feeding guidance, diabetes management guidance, or any other therapeutic dietary advice. Do not rely on this service for any medical, health, or allergy-management purpose. Always consult a qualified healthcare professional for advice specific to your health conditions and dietary needs.

12. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Intellectual Property

All content, design, software, trademarks, and materials provided by Coulter through the Service (excluding user content) are the property of Coulter or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

14. Third-Party Services

The Service integrates with third-party services including payment processors, AI providers, and analytics tools. Your use of third-party services is subject to those providers' terms and policies. We are not responsible for the practices, availability, or content of any third-party services.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COULTER DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COULTER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO USE THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL COULTER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

17. Indemnity

You agree to indemnify, defend, and hold harmless Coulter, its owners, operators, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: your use of the Service; your uploaded content; your reliance on any content provided through the Service; any breach of these Terms; or any violation of applicable laws or regulations.

18. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to Coulter or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

19. Changes to the Service

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

20. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after updated Terms are published constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New South Wales, Australia.
